1. What HarbourMind is

HarbourMind provides technology for discovery, referral, scheduling, payment and secure communications between clients and independent practitioners. We are a platform operator. We are not:

2. Emergency and crisis situations

If you or someone else is in immediate danger, call Hong Kong emergency services on 999 now. HarbourMind messages are not monitored continuously and must not be used for crisis response. In-app crisis prompts show emergency numbers and a reviewed hotline list. High-risk intake answers can pause automated matching and route the matter to trained agency staff.

HarbourMind does not provide crisis intervention, continuous monitoring, or clinical decision-making. Emergency decisions and ongoing clinical risk management within a counselling relationship remain with the independent practitioner and, where required, emergency services—not with the platform operator.

In Hong Kong, "counsellor" is not a statutory licensed title in the same way as some medical professions. HarbourMind verifies identity, qualifications, recognised membership or registration, professional indemnity insurance covering Hong Kong clients (including telecare), supervision, languages, scope and fitness-to-practise declarations before activation. Profiles show the verification date, jurisdiction and exact credential. Displayed credentials do not imply statutory licensure where none exists.

Matching only offers practitioners approved for Hong Kong clients. Care is treated as occurring where the client is physically located during the session. Overseas practitioners must declare the client jurisdictions they serve. Expired or disputed credentials suspend new bookings until reviewed.

The counselling relationship is between you and your practitioner. Each practitioner remains responsible for professional assessment, records, scope of practice and emergency decisions within that relationship, subject to their professional standards and indemnity cover.

5. Matching and AI assist

Matching uses hard filters (for example verification, jurisdiction, safety pause, language and budget) and may use AI soft-ranking or plain-language explanations. AI is decision-support only. It does not diagnose, create treatment plans, or replace agency or practitioner accountability. A trained Hong Kong agency reviewer can review and change referrals. You should read match explanations and choose a practitioner that feels appropriate for you.

6. Telehealth sessions

Before your first online session, you must accept a versioned telehealth consent covering benefits and limits of remote counselling, confidentiality and its exceptions, technology risks, fees and cancellation rules, identity/location/emergency-contact checks, telephone contingency, and the prohibition on recording without prior consent from both parties.

7. Fees, payments, cancellation and refunds

Before you pay, checkout shows the listed session fee in HKD, how HarbourMind's platform fee is treated, available payment methods, and the cancellation rules for that booking. By confirming payment you agree to those disclosed terms. Under Hong Kong consumer law we must not mislead you about price, who supplies the service, or material cancellation conditions.

Rescheduling with the same counsellor counts as a cancellation of the original slot and a new booking. A reschedule requested at least 24 hours before start does not forfeit the fee if the new time is confirmed; a late reschedule follows the late-cancellation rule unless the counsellor agrees otherwise in writing in the app.

Until payment rails are approved for Hong Kong production use, checkout may remain disabled or limited to supervised beta cohorts.

How payment works

  • You pay the listed session fee. HarbourMind's launch platform fee (15% of that fee) is taken from the listed amount — not added on top.
  • HarbourMind does not operate a stored-value wallet or hold client funds as a custodian. Production checkout uses a licensed marketplace / destination-charge flow; counsellors are paid to a provider connected account.
  • Successful payments generate a receipt with provider reference. Refunds, when due, return through the original payment method (timing depends on your bank or wallet).
  • For counselling relationships that begin through HarbourMind matching or booking, clients should pay session fees in the app (or the official HarbourMind checkout). Off-app private charges arranged to avoid platform fees are not covered by HarbourMind refund, receipt or safety protections.

Cancellation and refund rules (per session)

HarbourMind is a per-session marketplace, not a weekly subscription. Unless a different rule is shown at checkout for a specific booking, the following applies (times measured from the scheduled session start in Hong Kong time / the displayed local time):

  • Client cancels at least 24 hours before start: full refund to the original payment method. The counsellor is not paid for that session and HarbourMind does not keep the platform fee.
  • Client cancels less than 24 hours before start, or no-shows: no refund. The counsellor remains entitled to their net session fee and HarbourMind may keep its platform fee, because the slot was reserved.
  • Counsellor cancels, no-shows, or cannot continue: full refund, or a free rebook with the same or another approved counsellor at your choice. The counsellor is not paid for the missed session.
  • Platform or payment failure that prevents the session from starting: full refund or free rebook. We do not treat this as a client no-show.
  • Connection problems during a started session: use the agreed audio or telephone contingency. If the session cannot reasonably continue for technical reasons outside your control, contact support promptly; we may offer a free rebook or partial / full refund depending on how much of the session was delivered.
  • Special circumstances (for example sudden illness, safety escalation, or documented hardship): email support. We may approve a refund or free rebook case by case. This is discretion, not a guaranteed right beyond the rules above.

8. Acceptable use

You agree not to:

We may suspend or terminate access, cancel bookings, or report matters to authorities where reasonably necessary to protect users, practitioners, HarbourMind or the public.

9. Intellectual property

Argo Technology Group Limited or its licensors own HarbourMind's name, branding, software, designs and content. You receive a limited, revocable, non-transferable right to use the service for its intended purpose. Practitioners retain rights in their own professional materials subject to any licence needed for platform display. You must not copy or reuse platform content except for personal, non-commercial use of materials clearly provided for that purpose.

10. Privacy

Personal data is handled under our Privacy Policy & Collection Notice at /privacy and the Personal Data (Privacy) Ordinance (Cap. 486) (PDPO). By using the service you acknowledge that practitioners, agency staff and contracted processors may receive the data needed to deliver matching, booking, payment and sessions.

11. Service availability and changes

We aim to keep the platform available and to provide the service with reasonable care and skill. The beta may change, be interrupted, or be limited without prior notice. We may update features, matching rules, verification standards and these Terms as the service develops. Material changes will be notified in the app or by email where practicable. Continued use after the effective date of an update constitutes acceptance of the revised Terms, except where Hong Kong law requires a different method of agreement.

12. Disclaimers and liability

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under Hong Kong law, including liability for death or personal injury caused by negligence where such exclusion is prohibited, fraud, or rights under the Supply of Services (Implied Terms) Ordinance and other mandatory consumer protections.

Subject to the paragraph above:

Unfair or unconscionable terms may be unenforceable under Hong Kong law. If any provision is held invalid, the remaining provisions continue in effect.

13. Suspension and closure

You may stop using the service and request account closure through the app or support channels, subject to open bookings, payment disputes, safety matters and retention duties. We may suspend or close accounts for breach of these Terms, failed verification, safety risk, legal requirement, or end of the beta. Closure does not affect rights and obligations that by nature should survive, including fees already due, confidentiality, IP and liability provisions.

14. Governing law and disputes

These Terms are governed by the laws of the Hong Kong Special Administrative Region. The courts of Hong Kong have exclusive jurisdiction, without prejudice to any non-excludable consumer rights you may have. Before filing a claim, please contact us so we can try to resolve the issue.
